1. ELIGIBILITY: Open to legal U.S. residents who are 18 years of age and older. Employees of Discovery Communications, Inc., Discovery Health Channel, L.L.C. and Slim•Fast® Foods Company (together, the "Sponsors"), their subsidiaries, affiliates, sweepstakes administrator, advertising and promotion agencies and members of the immediate families (spouses and parents, children and siblings and their spouses) and persons living in the same household of such individuals are not eligible. Void where prohibited.
2. TO ENTER: There are four ways to enter the Discovery Health Body Challenge 2 Sweepstakes: online, in-store, at mall tour events and by mail. Online: the online entry period begins at 12:01 AM ET on January 1, 2003 and ends at 11:59 PM ET on January 30, 2003. To enter, go to www.discovery.com/health and access the Body Challenge 2 Sweepstakes page. If you are already a member of My Discovery and are logged in, just hit enter to automatically submit your information for a chance to win. If you are not a My Discovery member, you will be asked to complete a one-time registration form and become a member on your first visit. Complete the online entry form and submit it to be received by Sponsor's server by 11:59 PM ET on January 30, 2003. In-store: enter at participating Discovery Channel Stores by completing an Official Entry Form and placing it in the entry box from January 1 - 30, 2003. Mall tour events: enter at displays that are part of Discovery Health's Body Challenge 2 mall tour by completing an Official Entry Form and placing it in the entry box from January 1 - 30, 2003. Mail-in: complete an Official Entry Form available at participating Discovery Channel Stores from January 1 - 30, 2003. Mail your entry to be postmarked by January 30, 2003 and received by February 6, 2003 to: Discovery Health Body Challenge 2 Sweepstakes, PMI Station, PO Box 3538, Southbury, CT 06488-3538. No mechanical reproduction of entries permitted. Limit one entry (either email, in-store, mall tour or mail-in) per person per day.
3. PRIZE: On or about February 17, 2003, Promotion Mechanics, Inc., an independent judging organization, will conduct a random drawing from among all eligible entries received to award (1) Grand Prize: a trip for two to Spa Kea Lani in Maui, Hawaii, consisting of round trip coach air travel to Maui, from the major commercial airport closest to winner's residence; accommodations for 6 days/5 nights in a one-bedroom ocean view suite; breakfast each morning; and two spa treatments for each person. All other expenses not specified herein are the winner's sole responsibility. The winner will also receive a 12-month supply of Slim•Fast® replacement bars awarded in the form of product coupons. Total approximate retail value of Grand Prize is $5,000. Actual value will be determined by winner's residence and seasonal rates. Travel and accommodations are subject to availability; certain restrictions and blackout periods apply. Winner and guest must travel on the same itinerary. Travel must be completed by February 28, 2004 or prize will be forfeited in its entirety.
Winners will be notified by phone, mail and/or express mail at Sponsors' sole discretion. Odds of winning will be determined by the number of eligible entries received, which is estimated at 25,000.
4. GENERAL: Taxes on prize and all expenses related to acceptance and use of prize and not specified are the sole responsibility of winner. By participating, entrants agree [a] to these rules and decisions of Sponsors and judges, which shall be final in all respects relating to this sweepstakes; and [b] to release, discharge and hold harmless Sponsors, their subsidiaries, affiliates, advertising and promotion agencies, agents and representatives and their respective directors, officers and employees from any and all injuries, liability, losses and damages of any kind resulting from their participation in the sweepstakes or their acceptance, use or misuse of prize including, without limitation, personal injury, death and property damage. Winner will be required to complete an affidavit of eligibility, liability and (where legal) publicity release, which must be returned within time period specified in notification letter or an alternate winner may be selected. If a winner is not of the age of majority in his/her state of residence (i.e. states where age of majority is higher than 18), prize either will be awarded in the name of parent or legal guardian or parent or legal guardian must ratify and sign any and all documents required of winner. Travel companion, who must be 18 years of age or older, must complete and return a liability/publicity release prior to issuance of travel documents. Winner agrees to use of his/her name and/or photograph for advertising, publicity and promotional purposes in all media, including but not limited to on air and within Sponsor's website, www.discovery.com, without compensation (unless prohibited by law) and agrees to execute specific consent to such use if asked to do so. Sponsors, their affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective officers, directors and employees are not responsible for and shall not be liable for [a] any telecast, cable or telephone malfunctions, human error, satellite transmission failures, or delayed telecasts or preemption of or the failure of a cable affiliate to televise Discovery Health Channel® or any affiliated Sponsor network in all or any parts of the United States; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [c] failed, incomplete, garbled or delayed computer transmissions; [d] late, lost, misdirected or incomplete entries or postage-due mail; or [e] any condition caused by events beyond the control of the Sponsors that may cause the promotion to be disrupted or corrupted. Sponsors reserve the right to cancel or suspend the sweepstakes or any portion thereof should virus, bugs or other causes beyond the control of the Sponsors corrupt the administration, security or proper play of the promotion, in which case all prizes will be awarded via a random drawing from among all eligible entries received prior to cancellation. Entry information becomes property of Sponsors. No prize transfer or prize substitution. All federal, state and local regulations apply. Internet entry must be made by the entrant only at the authorized web site address of http://www.discovery.com. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites. Any winner who enters by any of the methods described above will be disqualified and an alternate winner selected. Use of any device to automate entry is prohibited.
5. ENTRY INFORMATION: Please note that if you check the "opt-in" box on the entry form for this sweepstakes, you are (i) agreeing that we may share your entry information (including your name, address, email address, etc.) with our promotional partners and other parties; and (ii) granting us, our promotional partners and other third parties with which we choose to share your information permission to contact you about our upcoming shows, promotions or for other reasons.
6. WINNER LIST: To receive winner's name, mail a self-addressed, stamped envelope to be received by February 28, 2003, to: Discovery Health Body Challenge 2 Sweepstakes Winner, PMI Station, PO Box 750, Southbury, CT 06488-0750.
